Junk Faxes ? New California Law Challenged
The Junk Fax Prevention Act was established in order into force on 1st Go January, 2006. In a rather shocking move, the U.S. Chamber of Commerce announced a preliminary injunction which was granted. Entry into the Chamber of Commerce is Xpedite Systems, a fax company. Filed in federal court, the injunction is granted and the law was made shall be enforced. A hearing on this issue will be held January 23, 2006 with the earliest settlement of the matter to 30th January 2006.
The focus of the dispute for an exemption, known in the law of the previous business relationship exemption. Under federal law, a person can send a fax to one person or company with which they had to send a previous relationship. The problem, however, there is no specific criterion for the assessment of a previous business relationship. The California law aims to require proof of such a relationship.
Ironically, the U.S. Chamber of Commerce is one of the largest and most boisterous supporters of the federal law was junk fax. In a mysterious change of position, the Chamber of Commerce is now the location of the California law is unduly burdensome on small and medium enterprises.
This position is so much nonsense, a typical attitude for the Industry and Commerce. In evaluating this statement bland positions, it is always important to use common sense. In this case, sending faxes to clients for a business is easy to go have proof of these relations. In fact, most companies now communicate via e-mail with their customers instead of a fax. If something needs to go wrote, it is typically done by mail.
Intentionally or not, the only parties, the U.S. Chamber of Commerce is to protect the junk fax senders. What a shame. Let’s hope the court makes the board in their place. P>
