To obtain a divorce in California, there is a fair amount of paperwork which needs to be filed with the court, especially if there are children involved.  In addition, there is a mandatory six month and one day waiting period, which is the minimum amount of time that must pass before the divorce may be final.   This waiting period begins once the Respondent is served with the Petitioner’s “lawsuit”.  During this waiting period, each party must provide financial disclosures to the other, one party may need to petition the court for temporary orders regarding support, custody, use of the family home, etc., and ultimately negotiate a final settlement of all issues.  If the parties are unable to negotiate a settlement, a trial may be necessary to resolve any disputed issues.
